EZDOWN MINIMUM ADVERTISED PRICE (MAP) POLICY

Stabilus has a MAP policy in effect on EZDown products. Any information relating to EZDown products in print or on an Internet website is considered to be advertising for the purposes of this policy. This means that an EZDown Authorized Retailer is not allowed to advertise or post a price below the MAP price.

Should you visit a site that advertises a price below MAP they are not an Authorized Retailer and are not getting the product through proper channels. This will affect your warranty status as an EZDown customer. The origin of the product may also be in question as used, B grade or gray market merchandise.

Stabilus has put these policies in place to protect you, the consumer, from dealers who have no knowledge of the products, provide no support and in some cases misrepresent the EZDown products’ capabilities; content; technical specifications; availability and history.

STABILUS

Stabilus Inc., 1201 Tulip Drive, Gastonia, NC 28052 (“Stabilus”) warrants to the original consumer purchaser that EZ-Down and mounting hardware will be free from defects in materials and workmanship under normal use and service for one year from the date of original consumer purchases. This limited warranty is not applicable if the product has been damaged by accident, improper installation, unreasonable or improper use, lack of proper maintenance, unauthorized repairs or modifications, normal wear and tear, or other causes not arising out of defects in materials or workmanship.

Stabilus’ obligation under this warranty is limited to repair of the product at Stabilus’ plant or replacement of the products at Stabilus’ option without expense to the original consumer purchaser. Any expenses involved in the removal, reinstallation or transportation of the product are not covered by this warranty. The product must be returned to Stabilus’ plant at the address above, postage pre-paid, and insured with proof of original purchase including date. If Stabilus is unable to replace the product and repair is not commercially practical or cannot be timely made, or if the original consumer purchaser is willing to accept a refund in lieu of repair or replacement, Stabilus may refund the purchase price, less an amount for depreciation. The acceptance by Stabilus shall not deemed an admission that the product is defective or in violation of any warranty. Products that are replaced or for which a refund is issued become the property of Stabilus.

THIS WARRANTY IS STABILUS’ ONLY EXPRESSED WARRANTY OF THESE PRODUCTS, NO IMPLIED WARRANTY INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, SHALL BE EXTENDED BEYOND THE WARRANTY PERIOD STATED ABOVE FOR EACH PRODUCT. STABILUS SHALL NOT BE LIABLE FOR ANY DAMAGES, FOR LOSS OF USE OF THIS PRODUCT, NOR FOR ANY OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES, COSTS, OR EXPENSES.

Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations and exclusion may not apply to you. This warranty gives you specific legal rights and you may have other rights which may vary from state to state.

Claims
EZ-Down’s are carefully inspected and packaged to assure that they will reach you in good condition. Product damage or loss occurring in transit is the responsibility of the carrier. In the event of such a loss, you must advise the carrier within 15 days after delivery and secure the carrier’s notation of damage or shortage in the freight bill. We suggest you file a claim with the carrier immediately thereafter. We will give all reasonable assistance in tracing shortages and filling claims.

Returns:
Any Product Return Must Have Prior Return Authorization

Non-Defective Products:
Stabilus will not accept any non-defective returns, unless due to the fault of Stabilus. Non-defective product returns will be subject to a minimum 50% handling charge, or will be returned to the customer at their expense.

Defective Product:
Credit will not be issued for materials returned without written authorization. Return requests must be mailed to our main office and must include an itemized list of materials to be returned, the reasons for return, and the date and number of the Stabilus invoice.
